Mediation as a way of resolving conflicts and disputes is not yet known to the legislation of Turkmenistan. In practice, standard forms of reconciliation are applied without the involvement of any intermediaries or specialists.
ABOUT MEDIATION IN TURKMENISTAN
The legislation of Turkmenistan does not provide for such a way of disputes resolution as mediation. At the moment, the standard forms of reconciliation are applied without the involvement of any intermediaries or specialists provided for by the labor code and relating to the disputes between employees and employers, the criminal code as part of the criminal’s elimination the harm caused to the victim, and the reconciliation of spouses within the framework of family law.
It should be noted that in this country there are periodic events devoted to the issues of mediation and the experience of foreign countries in this field. Educational events on mediation and other alternative ways of disputes resolution are also carried out at the initiative of foreign organizations in higher educational institutions. Therefore, there is a hope that mediation will appear in this country as well.
